226 Temporal Variation in Consent Litigation in General Surgery

Abstract Aim Issues with consent is one of the most common causes litigation within General surgery. The guidance surrounding informed in surgery has changed following Montgomery vs Lanarkshire Health Board (2015) court ruling. aim this study was to examine time trends medico-legal cases related between 2011–2020. Method Data on numbers general were obtained from NHS resolutions for period 2010–2020. Chi-squared analysis performed using SPSS compare proportion that due before and after 2015. Results There a total 10,027 claims made 2010–2020, which 580 (5.8%) issues consent. number rose during period, 208/2817 (3.76%) consent-related 2015, versus 372/3267 (8.12%) 2015; 116% increase (p<0.001). Conclusions These data illustrate significant rise post-Montgomery era. This may be legal precedent being established case, increased awareness these as result.
